GESC's Invention Patent and Trade Secrets on Melamine Recognized in 2023's Top Ten Rule of Law Cases

On January 24, 2024, the results of the "Top 10 Cases of 2023 for Promoting the Rule of Law in the New Era" jointly organized by the Supreme People's Court and China Central Television were officially announced. The case of GESC v. Shandong Hualu Hengsheng Chemical Co., Ltd. involving "melamine" invention patents and technical secrets was named one of the top 10 cases of the year. The selection activity was launched on December 24, 2023, and 45 typical cases will be selected from the cases concluded by courts nationwide in 2023. After online voting and expert selection, the case of GESC's invention patent and technical secrets related to "melamine" stood out and was successfully selected due to its typical significance and exemplary leading role.
Wang Yi, vice president of Renmin University of China and executive vice president and secretary-general of the Civil Law Research Association of China Law Society, believes that this case is currently a related case of intellectual property infringement with high compensation awarded by the people's court for the same project, which fully reflects the trial concept of strengthening judicial protection of intellectual property in the new era of strong protection, effective protection and equal protection. This case has promoted the process of rule of law in the new era, with a sword hanging high and guarding innovation.
