GESC's Invention Patent and Trade Secrets on Melamine Recognized in 2023's Top Ten Rule of Law Cases

On January 24, 2024, the results of the "Top 10 Cases of 2023 for Promoting the Rule of Law in the New Era" jointly organized by the Supreme People's Court and China Central Television were officially announced. The case of GESC v. Shandong Hualu Hengsheng Chemical Co., Ltd. involving "melamine" invention patents and technical secrets was named one of the top 10 cases of the year.

GESC Recognized Among Sichuan Province's Top 10 Social Responsibility Cases for Private Enterprises in 2023

On January 11th, the "Sichuan Province Private Enterprise Social Responsibility Report (2023)" (hereinafter referred to as the "Report") and the top ten private enterprise social responsibility cases in Sichuan Province were released in Chengdu. The report collected a total of 1819 valid samples, covering 21 cities (prefectures) and 18 industries in the province, with comprehensive regional distribution, wide industry involvement, and numerous large and medium-sized enterprises. GESC has been successfully selected as one of the "Top 10 Social Responsibility Cases of Private Enterprises in Sichuan Province in 2023" and also ranked 26th on the "Top 50 Leading Private Enterprises in Sichuan Province" list.

Regulations on the Safety Management of Hazardous Chemicals Regarding the Purchase of Hazardous Chemicals

Article 38： Enterprises that have obtained the Safety Production License, Safety Use License, and Business License for Hazardous Chemicals in accordance with the law shall purchase highly toxic chemicals and explosive hazardous chemicals with the corresponding licenses. Civil explosive production enterprises shall purchase hazardous chemicals that can be used to produce explosives with the Civil Explosive Production License.

Supreme People's Court Denies Retrial in Shandong Hualu Hengsheng Chemical Melamine Case

On June 12, 2023, the Supreme People's Court issued a civil ruling (2023) Gao Fa Min Shen 210, rejecting the application for retrial by Shandong Hualu Hengsheng Chemical Co., Ltd. (hereinafter referred to as Hualu Hengsheng) in response to the civil judgment (2022) Gao Zhi Fa Min Zhong 541 (i.e. our company's lawsuit against Hualu Hengsheng and four other defendants for infringement of melamine technology secrets).

On June 12, 2023, the Supreme People's Court issued a civil ruling [(2023) Supreme Court Civil Judgment No. 210], ruling on the retrial lawsuit of Shandong Hualu Hengsheng Chemical Co., Ltd. against the Supreme Court's civil judgment (2022) Supreme Court Civil Judgment No. 541 (Retrial Acceptance Letter [(2023) High Court Civil Judgment No. 210]), and rejecting the retrial application of Shandong Hualu Hengsheng Chemical Co., Ltd.

In order to further summarize and play a positive role in typical cases, effectively increase intellectual property protection, and maintain fair competition in the market, the Supreme People's Court selected 20 typical cases from 3468 technical intellectual property and monopoly cases concluded in 2022 on March 30, 2023. Among them, GESC Sincerity Chemical Co., Ltd., Beijing Edgein Technology Co., Ltd., Shandong Hualu Hengsheng Chemical Co., Ltd., Ningbo Houcheng Management Consulting Co., Ltd., Ningbo Antai Environmental Chemical Engineering Design Co., Ltd., and Yin Moumou's infringement of invention patent rights and infringement of technical secrets disputes were included in the "Typical Cases of Patent Civil Cases".
